These Terms and Conditions (“Terms”) govern all repair and maintenance services provided by Danny’s Automotive Inc. (“Danny’s Automotive,” “we,” “us,” or “our”) to you (“Customer,” “you,” or “your”). By authorizing an estimate, leaving your vehicle for service, or accepting delivery of a repaired vehicle, you agree to be bound by these Terms.
1. ESTIMATES AND AUTHORIZATION
1.1 Estimate Validity
All estimates are valid for thirty (30) days from the date issued. After this period, prices, parts availability, and labor times are subject to change. Estimates are based on initial observations and diagnostic findings; actual costs may vary if additional issues are discovered during repair.
1.2 Authorization to Proceed
By authorizing an estimate, you grant Danny’s Automotive permission to begin work immediately, including ordering necessary parts to expedite service. Authorization may be provided verbally (in person or by phone), via text message, email, or through our digital authorization system. We maintain records of all authorizations.
1.3 Additional Repairs
If additional repairs are identified during the service process, we will contact you with an updated estimate before proceeding. No additional work will be performed without your prior authorization. If we are unable to reach you after reasonable attempts (minimum of two phone calls and one text message over a 24-hour period), work will be paused and storage fees may apply after 48 hours.
1.4 Mid-Repair Discoveries
During the course of authorized repairs, additional issues may be discovered that were not visible or diagnosable prior to disassembly. These may include:
- Components that must be repaired or replaced to complete the original authorized work
- Damage discovered only after removal of other parts
- Parts damaged during normal disassembly (corroded bolts, brittle clips, gaskets, one-time-use fasteners)
- Wear or leaks in related components that are only accessible during the current repair
Authorization for Additional Work. We will contact you promptly when significant additional work is identified. However, minor items required to complete the job safely and properly (such as replacement of damaged fasteners, gaskets, seals, or hardware) may be performed without separate authorization and will be added to the final invoice.
Required Repairs. Some discoveries are mandatory to complete the original repair. If you decline required additional work, we may be unable to reassemble or return the vehicle in safe, operational condition. In such cases:
- You remain responsible for all labor performed to date, including disassembly
- You remain responsible for all parts ordered, subject to Section 3 (Cancellation and Restocking Fees)
- If reassembly without the additional repair would render the vehicle unsafe or inoperable, we reserve the right to decline reassembly until the required repair is authorized
- Danny’s Automotive is not liable for any condition resulting from customer refusal of required repairs
Recommended Repairs. When additional work is recommended but not required to complete the original repair, you may decline without affecting the original service. However, we strongly recommend addressing issues discovered during teardown when labor overlaps significantly, as future repair will require repeating disassembly labor.
Labor Adjustment. When additional authorized repairs share labor operations with the original repair (such as removal/reinstallation of the same components), we will adjust labor charges to reflect actual time required rather than charging full labor for each repair separately.
2. DEPOSITS AND PAYMENT
2.1 Deposit Requirements
For repairs with an estimated cost exceeding $1,500, a deposit of fifty percent (50%) is required before parts are ordered. This deposit ensures prompt procurement of components and timely completion of repairs. Deposits may be paid by cash, check, or credit/debit card.
2.2 Deposit Application
All deposits are non-refundable. In the event of cancellation or change of scope, deposits will be applied in the following order:
- Diagnostic fees
- Labor completed to date
- Parts costs and applicable restocking fees
Any remaining balance after these deductions will be refunded within fourteen (14) business days.
2.3 Payment Terms and Available Options2.3 Payment Terms
Full payment is required upon completion of repairs before vehicle release. We accept cash, check, and major credit/debit cards. For commercial accounts with established credit, net-30 terms may be available upon approval.
2.4 Vehicle Release
Vehicles will not be released until all charges are paid in full, including any applicable storage fees. If you choose to take custody of your vehicle while waiting on parts or further service, all diagnostics and repairs completed to that point must be paid in full, and a deposit for upcoming parts must be provided.
2.5 Refund Policy
All sales for completed repairs and services are final. No refunds will be issued for work that has been performed and the vehicle released to the customer.
If you experience any issue with a completed repair:
- Contact Danny’s Automotive immediately
- All concerns must be processed through our Warranty Claim Procedure (Section 7.3)
- Danny’s Automotive must be given the opportunity to inspect and correct any claimed defect before you seek repair elsewhere (Section 10.3)
Customers who bypass our warranty process by having related work performed at another facility, or who initiate chargebacks or payment disputes without first completing our dispute resolution process (Section 12), forfeit any right to refund, warranty coverage, or further remedy.
Chargebacks on completed work will be disputed and may result in collection action for the full amount owed plus all applicable fees, costs, and attorney fees incurred in the dispute and collection process.
2.6 Payment Disputes and Chargebacks
Acknowledgment of Payment Obligation. By authorizing repairs, you acknowledge that payment for completed services constitutes a binding obligation. Credit card chargebacks and payment disputes are consumer protections designed for unauthorized transactions, fraud, and billing errors—not for disputes regarding the quality, timeliness, or outcome of services that were authorized and performed.
Exhaustion of Remedies Required. Before initiating any chargeback, payment dispute, or credit card claim, you agree to:
- Contact Danny’s Automotive directly to attempt resolution (Section 12.1)
- Complete our Warranty Claim Procedure if applicable (Section 7.3)
- Allow Danny’s Automotive the opportunity to inspect and remedy any claimed defect (Section 10.3)
- Engage in good faith negotiation for thirty (30) days (Section 12.2)
Improper Chargebacks. A chargeback filed for completed, authorized repairs—without first exhausting the remedies above—constitutes:
- A material breach of this Agreement
- An acknowledgment that the disputed amount remains due and owing
- Authorization for Danny’s Automotive to pursue all available remedies
Merchant Rights Reserved. Danny’s Automotive reserves the right to:
- Dispute and contest any chargeback through the card network process
- Pursue the full amount owed, plus all chargeback fees, representment costs, and administrative expenses, through collection action, small claims court, or other legal remedies, regardless of chargeback outcome
- Report unpaid balances to credit bureaus and collection agencies
- Decline future service to customers who have filed chargebacks without exhausting dispute resolution procedures
- Exercise mechanic’s lien rights on any vehicle subsequently brought in for service until prior balances are satisfied
Documentation. Danny’s Automotive maintains records of all authorizations, communications, and service documentation. By signing or digitally authorizing any estimate, invoice, or work order, you acknowledge receipt of and agreement to these Terms, including this Payment Disputes section.
No Waiver of Consumer Rights. Nothing in this section is intended to waive any rights you may have under the Fair Credit Billing Act for unauthorized transactions, fraud, or billing errors. This section applies only to disputes regarding authorized, completed services where internal dispute resolution has not been attempted.
3. CANCELLATION AND RESTOCKING FEES
3.1 Cancellation Policy
You may cancel authorized repairs at any time, subject to the following:

3.2 Non-Returnable Parts
The following parts are considered non-returnable and are charged at 100% if ordered:
- Electrical components and sensors
- Programmed modules and computers
- Special order items
- Dealer-only parts
- Cut, installed, or modified parts
- Parts without original packaging
4. DIAGNOSTIC SERVICES
Diagnostic services are charged at a flat rate of $150. This fee is standalone and non-refundable, regardless of whether subsequent repairs are authorized. The diagnostic fee compensates for technician time, equipment use, and expertise required to identify vehicle issues. This fee is not credited toward repairs.
5. DIAGNOSTIC LIMITATIONS AND REPAIR SCOPE
5.1 Nature of Automotive Diagnosis
Automotive diagnosis identifies the most probable cause of a reported symptom based on conditions present at the time of inspection. Modern vehicles contain complex, interdependent systems where multiple components can produce identical or similar symptoms. Diagnosis is not a guarantee of symptom elimination but rather a professional assessment of the most likely source of the problem based on available evidence, test results, and technician expertise.
5.2 Repair Scope
Each authorized repair addresses only the specific component(s) identified in the estimate. Authorization to repair a diagnosed component does not constitute a guarantee that:
- All symptoms will be eliminated
- No additional related issues exist
- The vehicle will not require further repairs for similar symptoms
- Other components in the same system are free of defects
5.3 Secondary and Related Failures
It is common for vehicles to have multiple failures affecting the same system or producing similar symptoms. Repair of one component may:
- Reveal secondary issues that were masked by the original failure
- Restore function that exposes wear or damage in related components
- Change system dynamics in ways that make previously borderline components fail
- Allow proper testing of components that could not be evaluated prior to the initial repair
When this occurs, additional diagnosis and separate authorization are required before proceeding with further repairs. The customer is responsible for the cost of any additional diagnosis and repairs.
5.4 Distinction from Warranty Claims
A persistent or recurring symptom after repair does not automatically indicate a defective repair or failed part. If the component we replaced is functioning correctly but symptoms persist due to a separate issue, this is not a warranty matter. Warranty coverage (Section 7) applies only when the specific part installed or work performed by Danny’s Automotive is itself defective or fails.
Customers who experience persistent symptoms after a repair should contact us promptly for re-evaluation. Additional diagnostic fees may apply if the symptom is determined to originate from a component or system not addressed in the original repair.
5.5 Customer Acknowledgment
By authorizing repairs, you acknowledge that:
- You have been given the opportunity to ask questions about the diagnosis
- You understand that the repair addresses only the specified component(s)
- Additional issues may exist that require separate diagnosis and repair
- Symptom resolution is the goal but not a guarantee of every repair
- Persistent symptoms require re-evaluation and may incur additional charges
6. STORAGE AND ABANDONED VEHICLES
6.1 Vehicle Pickup Requirement
Vehicles must be retrieved within forty-eight (48) hours of completion notification. Completion notification will be sent via phone, text message, and/or email to the contact information on file.
6.2 Storage Fees
A storage fee of $65 per day will be charged for vehicles not picked up within the 48-hour window. Storage fees accrue daily and are added to the repair invoice. Storage fees must be paid in full before vehicle release.
6.3 Abandoned Vehicle Procedure
Vehicles not retrieved will be handled according to the following schedule:

6.4 Mechanic’s Lien
Pursuant to Texas Property Code Chapter 70, Danny’s Automotive has a possessory lien on your vehicle for all unpaid charges, including repair costs, storage fees, and any costs of collection. We reserve the right to retain possession of your vehicle until all amounts owed are paid in full. If you fail to pay and retrieve your vehicle within the timeframes specified above, we may pursue foreclosure of the lien and sale of the vehicle to satisfy the debt, plus reasonable attorney fees and costs of collection.
7. WARRANTY
7.1 Warranty Coverage by Customer Type

Warranty period is measured from the date of repair completion, whichever occurs first (time or mileage). Garage Pass members should refer to dannysautomotiveinc.com/garage-pass for complete membership terms. Fleet customers are not eligible for Garage Pass membership.
7.2 Warranty Exclusions
The following are expressly excluded from warranty coverage:
- Drivetrain components: Engines, transmissions, transfer cases, and differentials
- Normal wear items: Brake pads/rotors, tires, belts, hoses, wiper blades, light bulbs, batteries, and filters
- Pre-existing conditions: Issues not addressed in the original repair
- Abuse, neglect, or accidents: Damage resulting from customer misuse, failure to maintain, collision, or environmental damage
- Modifications: Any modifications to the vehicle or repaired components after service
- Continued operation: Damage caused by continued operation after a warning light, symptom, or issue appeared
- Third-party repairs: Any related work performed by another shop after our repair
- Racing or competition: Any use of the vehicle in racing, competition, or off-road events
- Aftermarket accessories: Electrical issues caused by aftermarket installations
- Tires: Tire warranty must be purchased separately; tires are covered by manufacturer warranty only
7.3 Warranty Claim Procedure
To make a warranty claim:
- Contact Danny’s Automotive immediately upon noticing an issue
- Do not continue driving if experiencing symptoms related to the original repair
- All warranty service must be pre-approved by Danny’s Automotive management before any repairs are made
- For vehicles located in the Permian Basin, warranty service will be performed at Danny’s Automotive. For vehicles outside the area, we will assist in locating a qualified shop and may supply parts directly
7.4 Warranty Limitations
- Warranty coverage shall not exceed the original repair cost
- Warranty is non-transferable and valid only for the original customer
- Warranty does not extend to subsequent owners if vehicle ownership changes
- This is a LIMITED WARRANTY providing specific legal rights; you may have additional rights that vary by state
7.5 Sublet Work
Certain specialized repairs may be performed by third-party specialists (sublet work). Sublet work is covered by the performing shop’s warranty terms, which will be provided to you. Danny’s Automotive will assist in coordinating any warranty claims for sublet work.
8. PERSONAL PROPERTY
8.1 Customer Responsibility for Personal Items
Danny’s Automotive is not responsible for any personal property left in, on, or attached to your vehicle, including but not limited to:
- Items in the cab, console, glove box, or storage compartments
- Items in the truck bed, toolboxes, or cargo areas
- Aftermarket accessories, equipment, or modifications
- Cash, jewelry, electronics, firearms, or other valuables
- Tools, work equipment, or supplies
8.2 Recommendation
We strongly recommend removing all personal items and valuables from your vehicle before leaving it for service. If items must remain in the vehicle, please notify your service advisor in writing and acknowledge that Danny’s Automotive assumes no liability for loss, theft, or damage to such items.
8.3 Limitation
Any claims for lost or damaged personal property must be made in writing within 24 hours of vehicle pickup. Danny’s Automotive’s liability for personal property, if any, shall not exceed $100 regardless of the value of items claimed.
9. CUSTOMER RESPONSIBILITIES
To maintain warranty coverage and ensure proper service, you agree to:
- Provide accurate and complete vehicle history when requested
- Report any issues or concerns promptly upon noticing them
- Not continue driving if experiencing symptoms related to a recent repair
- Allow inspection of the vehicle before any warranty claim is processed
- Maintain the vehicle according to manufacturer specifications
- Keep contact information current for service notifications
- Retrieve vehicle within 48 hours of completion notification
- Remove personal property and valuables prior to service (Section 8)
10. LIMITATION OF LIABILITY
10.1 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANNY’S AUTOMOTIVE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO SERVICES PROVIDED SHALL NOT EXCEED THE COST OF THE SPECIFIC REPAIR AT ISSUE.
10.2 Exclusion of Consequential Damages
DANNY’S AUTOMOTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOST WAGES OR INCOME, RENTAL CAR COSTS, TOWING EXPENSES, MISSED APPOINTMENTS OR BUSINESS OPPORTUNITIES, LOSS OF USE, OR ANY OTHER PECUNIARY LOSS, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE.
10.3 Right to Repair
Danny’s Automotive must be given the opportunity to inspect and correct any claimed defect before you seek repair elsewhere. Failure to provide this opportunity may void any warranty claim.
11. PARTS AND MATERIALS
11.1 Parts Sourcing
Danny’s Automotive reserves the right to use OEM (Original Equipment Manufacturer), OE-equivalent, or quality aftermarket parts at our discretion unless otherwise specified in writing on the estimate. All parts used meet or exceed manufacturer specifications.
11.2 Customer-Supplied Parts
Danny’s Automotive does not accept customer-supplied parts. This policy ensures quality control, proper fitment, and allows us to stand behind our repairs with full warranty coverage.
11.3 Old Parts
Replaced parts are available for customer inspection upon request made at the time of service authorization. Parts not requested will be disposed of or returned for core credit. Certain parts (cores, hazardous materials) cannot be returned to the customer.
12. DISPUTE RESOLUTION
12.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact Danny’s Automotive management directly to attempt to resolve the dispute informally. We are committed to working with you in good faith to address any concerns. Please contact us at (432) 684-8665 or service@dannysautomotiveinc.com.
12.2 Good Faith Negotiation
Both parties agree to engage in good faith negotiation for a period of thirty (30) days before pursuing any legal action or payment dispute. This period begins upon written notice of the dispute.
12.3 Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action arising from these Terms or services provided shall be brought exclusively in the state or federal courts located in Midland County, Texas, and you consent to the jurisdiction of such courts.
12.4 Attorney Fees
In any action to enforce these Terms or collect amounts owed, the prevailing party shall be entitled to recover reasonable attorney fees and costs of collection.
13. RIGHT TO REFUSE SERVICE
Danny’s Automotive reserves the right to decline service on any vehicle at our discretion, including but not limited to vehicles deemed unsafe to operate, vehicles with undisclosed modifications, customers with prior unpaid balances or unresolved chargebacks, or customers who have violated these Terms or engaged in abusive behavior toward our staff.
14. COMMUNICATIONS
By providing your contact information, you consent to receive communications from Danny’s Automotive regarding your service, including:
- Service status updates and completion notifications
- Appointment confirmations and reminders
- Authorization requests for additional work
- Promotional offers and service specials
Message and data rates may apply for text messages. Reply STOP to opt out of promotional messages. Opting out of promotional messages will not affect transactional communications related to your service.
15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with any estimate or invoice provided, constitute the entire agreement between you and Danny’s Automotive regarding the services provided.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Modifications
Danny’s Automotive reserves the right to modify these Terms at any time. Updated Terms will be posted at dannysautomotiveinc.com/terms. Continued use of our services after modifications constitutes acceptance of the updated Terms.
15.4 No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

ACKNOWLEDGMENT
By authorizing an estimate, leaving your vehicle for service, or accepting delivery of a repaired vehicle, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the deposit requirements, cancellation and restocking fees, refund policy, chargeback and payment dispute provisions, diagnostic limitations, personal property limitations, storage fees, warranty limitations, and limitation of liability provisions.
