This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you enroll in and use our Garage Pass membership program (“Garage Pass” or “Membership”) and interact with our services.

2. INFORMATION WE COLLECT

2.1 Information You Provide to Us

When you enroll in Garage Pass or use our services, we may collect the following categories of information that you provide directly to us:

Contact Information: Name, mailing address, email address, and telephone number(s).

Vehicle Information: Vehicle make, model, year, VIN (Vehicle Identification Number), license plate number, mileage, and registration information.

Payment Information: Credit card number, debit card number, or other payment method details. Note: Payment information is processed and stored by our payment processor, Stripe, and we do not store complete payment card numbers on our systems.

Account Information: Username, password (encrypted), Membership tier, enrollment date, and account preferences.

Communication Records: Records of your communications with us, including emails, text messages, phone call logs, and any feedback or inquiries you submit.

2.2 Information We Collect Automatically

When you interact with our customer portal or website, we may automatically collect certain information, including:

Device Information: IP address, browser type, operating system, and device identifiers.

Usage Information: Pages viewed, links clicked, date and time of visits, and referring website addresses.

Cookies and Similar Technologies: We may use cookies, web beacons, and similar tracking technologies to collect information about your browsing activities. You can control cookies through your browser settings.

2.3 Information We Generate

In the course of providing services, we create and maintain records related to your Membership and Vehicle(s), including:

Service History: Records of all services performed on your Vehicle(s), including dates, descriptions, parts used, costs, warranty information, and technician notes.

Billing History: Records of Membership Fee payments, service charges, and transaction history.

Diagnostic Information: Vehicle diagnostic codes, inspection results, and repair recommendations.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

3.1 Providing and Managing Your Membership

  • Processing your Membership enrollment and managing your account
  • Processing Membership Fee payments and maintaining billing records
  • Scheduling and performing services on your Vehicle(s)
  • Administering warranty claims and coverage
  • Verifying Vehicle and Household eligibility for Membership benefits

3.2 Communications

  • Sending service reminders, appointment confirmations, and status updates
  • Notifying you of changes to your Membership, pricing, or these policies
  • Responding to your inquiries and providing customer support
  • Sending promotional offers and marketing communications (with your consent)

3.3 Business Operations

  • Maintaining accurate business and financial records
  • Analyzing Membership trends and improving our services
  • Detecting and preventing fraud, abuse, or misuse of Membership benefits
  • Complying with legal obligations and enforcing our Terms of Service

4. HOW WE SHARE YOUR INFORMATION

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including:

Payment Processing: We use Stripe to process Membership Fee payments. Stripe’s collection and use of your payment information is governed by the Stripe Privacy Policy, available at https://stripe.com/privacy.

Communications: We may use third-party services to send emails, text messages, and other communications.

Analytics: We may use analytics providers to help us understand how our website and services are used.

These service providers are contractually obligated to use your information only for the purposes of providing services to us and are required to maintain the confidentiality of your information.

4.2 Parts Suppliers and Warranty Administrators

We may share Vehicle and service information with parts suppliers and warranty administrators as necessary to fulfill warranty claims (including tire manufacturer warranties) and obtain parts for your repairs.

4.3 Legal Requirements

We may disclose your information if required to do so by law, court order, subpoena, or other legal process, or if we believe in good faith that such disclosure is necessary to: (a) comply with applicable laws or legal obligations; (b) protect our rights, property, or safety, or that of our customers or others; (c) investigate fraud or respond to a government request; or (d) enforce our Terms of Service.

4.4 Business Transfers

If Danny’s Automotive is involved in a merger, acquisition, sale of assets, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

4.5 With Your Consent

We may share your information with third parties when you have given us your explicit consent to do so.

5. DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including:

  • For the duration of your Membership and for a reasonable period thereafter to service any warranties or respond to inquiries
  • As required by applicable tax, legal, and regulatory requirements
  • To resolve disputes and enforce our agreements

Vehicle service records are retained in accordance with automotive industry standards and applicable law, typically for a minimum of seven (7) years, to support warranty claims and maintain accurate service histories.

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Encryption of sensitive data in transit and at rest
  • Access controls limiting employee access to personal information on a need-to-know basis
  • Secure payment processing through PCI-compliant payment processors
  • Regular review and updates of our security practices

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

You may access and update your account information at any time by logging into the customer portal or by contacting us. If you believe any information we have about you is inaccurate, please contact us and we will make reasonable efforts to correct it.

7.2 Communication Preferences

Email Marketing: You may opt out of promotional emails by clicking the “unsubscribe” link in any marketing email or by contacting us. Please note that even if you opt out of marketing emails, we will still send you transactional emails related to your Membership (such as payment confirmations, service reminders, and policy updates).

Text Messages: You may opt out of text messages at any time by replying STOP to any message we send. You may also contact us to update your text message preferences.

7.3 Deletion Requests

You may request deletion of your personal information by contacting us. Please note that we may be required or permitted to retain certain information for legal, regulatory, or legitimate business purposes, including maintaining service records and fulfilling warranty obligations.

7.4 Do Not Track

Some web browsers transmit “Do Not Track” signals. We do not currently respond to “Do Not Track” signals because there is no industry standard for how to respond to such signals.

8. CHILDREN’S PRIVACY

Garage Pass is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information promptly. If you believe we have collected information from a child under 18, please contact us.

9. THIRD-PARTY LINKS

Our website or communications may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to read the privacy policies of any third-party websites you visit.

10. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify you of any material changes by posting the updated Privacy Policy on our website and updating the “Effective Date” at the top of this policy. We may also notify you by email for significant changes. Your continued use of Garage Pass after any changes indicates your acceptance of the updated Privacy Policy.

11. TEXAS RESIDENTS

Under the Texas Data Privacy and Security Act (TDPSA), Texas residents may have certain rights regarding their personal information. While Danny’s Automotive qualifies as a small business under federal Small Business Administration standards and is generally exempt from the TDPSA’s requirements, we are committed to providing transparency about our data practices as described in this Privacy Policy.
